Crimes against Children 11-20-12

Mineapolis, MN
United States Attorney Brendan V. Johnson announced that an Eagle Butte, South Dakota man charged with sexual abuse of a person incapable of consenting was sentenced on November 13, 2012, by United States District Judge Roberto A. Lange. Cody Dean High Elk, age 29, was sentenced to 72 months in custody, three years of supervised release, and a $100 special assessment to the Victim Assistance Fund.

The conviction arose from a September 2002 incident in Dupree, South Dakota, when High Elk sexually assaulted the victim at a time when the victim was incapable of appraising the nature of the sexual conduct and incapable of communicating the victim’s unwillingness to engage in the sexual act.

United States Attorney Brendan V. Johnson announced that Anthony Fast Horse, age 58, of Rosebud, was convicted of one count of sexual abuse and found not guilty of one count of aggravated sexual abuse and two counts of sexual abuse as a result of a federal jury trial in Pierre, South Dakota. The charge carries a maximum penalty of life imprisonment, a $250,000 fine, or both.

Fast Horse was indicted by a federal grand jury for the charge on March 13, 2012. The conviction stems from an incident that took place on or about between December 1, 2010 and December 31, 2010, in which Fast Horse sexually abused the victim.

United States District Judge John A. Mendez sentenced Timothy Gevock, 27, of Stockton, today to five years and 10 months in prison, to be followed by a lifetime period of supervised release, for downloading child pornography, United States Attorney Benjamin B. Wagner announced.

According to court documents, in June 2011, the Greater Manchester Police notified the Cyber Crimes Center through Interpol that Gevock, using the e-mail address “evilgamer209@yahoo.com” had received child pornography from a British national. These images were sent via e-mail by a person named Campbell living in Manchester, England. Campbell was molesting a 4-year-old girl and trading the pictures with people on a Russian photo sharing site, including Gevock. In e-mails recovered during the Interpol investigation, Gevock wrote that he would “love to trade pics” with Campbell. Campbell then sent an e-mail with six images of child pornography attached. Gevock offered to send pictures of a 13-month-old he watched, and he attached a non-pornographic picture of his daughter in the bathtub.

This afternoon, a U.S. District Judge sentenced Johnson John, 65, an enrolled member of the Navajo Nation who resides in Church Rock, New Mexico, to a five-year term of imprisonment for his aggravated sexual abuse conviction.

On June 26, 2012, John entered a guilty plea to count four of the indictment charging him with aggravated sexual abuse of a minor.

In his plea agreement, John admitted that, between May 1, 2000 and September 1, 2000, he attempted to sexually assault a 12-year-old female child. John admitted luring the child victim into his home and attempting to rape her. He did not complete the sexual assault because he noticed another child watching through the window.

David M. Ketchmark, Acting United States Attorney for the Western District of Missouri, announced that a Mountain Grove, Missouri man pleaded guilty in federal court today to possessing thousands of images and videos of child pornography.

Ricky Burton Friend, 57, of Mountain Grove, pleaded guilty before U.S. Magistrate Judge James C. England to the charge contained in a June 19, 2012 federal indictment.

According to today’s plea agreement, an employee of a computer repair store contacted the FBI when he found child pornography on Friend’s desktop computer. Friend had brought his computer into the store to be repaired after it was damaged in an electrical storm. While working on the computer, the employee discovered the child pornography.

After Friend picked up his repaired computer, law enforcement officers executed a search warrant at Friend’s residence and seized the computer, two digital cameras, and other related items. A child pornography video was downloading to Friend’s computer when the officers arrived to execute the search warrant.
