Crimes against Children 11-7-12, Part II

Pittsburgh, PA
A resident of Mt. Lebanon, Pennsylvania pleaded guilty in federal court to child pornography charges, United States Attorney David J. Hickton announced today.

Andrew Dahmen, 22, of 10 Lebanon Hills Drive, Mt. Lebanon, Pennsylvania, pleaded guilty to possessing child pornography before Senior United States District Judge Gustave Diamond.

In connection with the guilty plea, the court was advised that, on January 2, 2012, Mt. Lebanon police responded to a pizza restaurant at 713 Washington Road, after the father of a 5 year-old child reported that Dahmen had attempted to produce a cellular telephone image of the child in the bathroom. Further investigation resulted in the seizure of the cellular phone as well as computers and storage media from Dahmen’s residence. Dahmen was found to be in possession of hundreds of images of child pornography, including images depicting prepubescent minors.

Charleston, WV
U.S. Attorney Booth Goodwin announced that a Kanawha County man pleaded guilty in federal court on Tuesday (November 6) to possession of child pornography. Michael Lee McCormick, 42, of Winifrede, Kanawha County, West Virginia, admitted that on November 26, 2008, he knowingly possessed on his computer more than 600 images depicting child pornography. The defendant admitted that he knew the images constituted child pornography. McCormick also admitted that many of the images depicted prepubescent minors. McCormick also admitted that he shared some of the images with other Internet users by means that included a computer.

Kansas City, MO
David M. Ketchmark, Acting United States Attorney for the Western District of Missouri, announced that a Kansas City, Missouri man was sentenced in federal court today for drugging and molesting 13 child victims, with some of the sexual abuse videotaped, over a four-year period.

James Phillip “Phil” Edwards, 63, of Kansas City, was sentenced by U.S. District Judge Dean Whipple to 245 years in federal prison without parole.

“We’re satisfied that an extremely dangerous sexual predator is guaranteed to spend the rest of his life in prison,” Ketchmark said. “A virtual life sentence is the only just resolution for a self-confessed pedophile who drugged innocent children in order to sexually abuse them and then recorded videos of his molestation. This serial abuser will never victimize another child for the rest of his life.”

On March 16, 2012, Edwards pleaded no contest and the court entered a judgment of guilty to all 21 counts contained in an April 7, 2010, federal indictment. Edwards was found guilty of 12 counts of producing videos of the sexual abuse of 12 separate children, the attempted production regarding a 13th child, the advertising and attempted distribution over the Internet of images of the sexual abuse of other children, and possession of a large collection of child pornography downloaded from the Internet. The court also found Edwards guilty of five counts of administering a drug to some of the victims to facilitate these crimes.

Orlando, FL
A federal jury found Luis E. Morales (58, Ormond Beach) and Rebecca Rivera (27, Hartford, Connecticut) guilty yesterday of one count of sex trafficking of a minor and two counts of transporting a minor over state lines with the intent to engage in sexual activity. Morales was also convicted of three additional counts of transporting a minor over state lines with the intent to engage in sexual activity. Morales and Rivera each face a maximum penalty of life in federal prison. Their sentencing hearing is scheduled for January 22, 2013.

According to evidence presented at trial, Morales was a self-proclaimed “Apostle” in a ministry he founded called En Fuego for Jesus. Rivera was one of his “prophets” in the ministry. In November 2009, Morales and Rivera transported a 12-year-old minor, who was also a member of the ministry, from Florida to Connecticut knowing that the minor would be caused to engage in a commercial sex act. In December 2010, Morales transported another minor, age 13, who was also a member of the ministry. He transported the victim from Arizona to Florida, and then to the Virgin Islands, with the intent to engage in sexual activity with the minor.

Cadiz, OH
More information has been released regarding an alleged child pornography ring operating out of the village. Three people have been arraigned.

Christina Reed, 33, 583 East Market St., Cadiz, has been charged with three counts of pandering obscenities involved a minor and two counts illegal use of a minor in nudity oriented material or performances, all felonies of the second degree.

Chad Tyler, 29, 413 St. Clair Avenue, was charged with two counts of pandering obscenities involving a minor, felonies of the fourth degree, complicity in illegal use of a minor in nudity oriented material or performances, a felony of the second degree, and complicity in pandering obscenities involving a minor, a felony of the second degree.

Jessica Manbeck, 36, 351 St. Clair Avenue, Cadiz, was charged with two counts of pandering obscenities involving a minor. a felony of the second degree, and illegal use of a minor in a nudity oriented material or performance, a felony of the second degree.

Beloit, WI
Anthony Sibley
A Beloit man is arrested on suspicion of 14 counts of possessing child pornography after an investigation by the Rock County Sheriff’s Office.

Detectives said a search warrant was used to search the home of Anthony Sibley at 1520 Oak St. on Oct 23.  Deputies said they seized items used to store and facilitate the sharing of child pornography files over the Internet.


Slidell, LA
Paul A. Pichon, 39,  of Slidell was arrested and charged with eight counts of possessing pornography involving juveniles.Two men from Southeast Louisiana have been arrested and charged with possessing pornography involving juveniles this week, according to the Louisiana Attorney General’s office.

Although not connected, both men were arrested following an investigation by the Attorney General’s High Technology Crime Unit.
On Monday, 39-year-old Paul A. Pichon of Slidell was arrested and charged with eight counts of possessing pornography involving juveniles after a joint investigation with the Slidell Police Department.

Two men from Southeast Louisiana have been arrested and charged with possessing pornography involving juveniles this week, according to the Louisiana Attorney General’s office.If convicted, Pichon could face up to 20 years in prison on each count and fines up to $50,000.

Pichon, who was booked into the St. Tammany Parish Jail, has since been released after posting bond.
On Wednesday, Marvin Thornton, 49, of Denham Springs, was arrested and charged with 100 counts of possessing pornography involving juveniles.

Thornton, who was on probation for a 2011 obscenity conviction is currently being held at the Livingston Parish Detention Center in lieu of a $10 million bond.

Sacramento, CA
John Patrick Frost Jr., 28, of Rocklin, pleaded guilty today to one count of possession of visual depictions of minors engaged in sexually explicit conduct, United States Attorney Benjamin B. Wagner announced.

According to court documents, on March 12, 2009, a photo-sharing website reported to the National Center for Missing & Exploited Children Cybertipline that a user had posted child pornography to their page. Further investigation led to a residence in Placer County where Frost spent time. According to the plea agreement, Frost admitted that between March 1, 2009 and August 9, 2009, he knowingly possessed images of child pornography. He further admitted that he had two prior state convictions involving child pornography.

Ft. Lauderdale, FL
Wifredo A. Ferrer, United States Attorney for the Southern District of Florida; Michael B. Steinbach, Acting Special Agent in Charge, Federal Bureau of Investigation (FBI), Miami Field Office; and Franklin C. Adderly, Chief of Police, Fort Lauderdale Police Department, announce that Van Lawson Williams, 49, of Fort Lauderdale, was convicted by a jury today of sex trafficking of minors, in violation of Title 18, United States Code, Section 1591(a)(1). Sentencing has not yet been scheduled.

After a six-day trial before U.S. District Judge Daniel T.K. Hurley, the jury found defendant Williams guilty of four counts of sex trafficking of minors and one count of attempted sex trafficking of minors. During trial, six victims, all runaways at the time they met Williams, testified that they worked or were recruited to work as prostitutes at Williams’ residence. According to the trial evidence, Williams befriended minor female runaways in his neighborhood and invited them to stay with him at his Fort Lauderdale residence, promising them food and shelter. Williams would then convince the girls to work as prostitutes. When the customers arrived at Williams’ residence, they paid Williams a “rental fee” for use of one of the bedrooms. The customers would then engage in sexual activity with the minor of their choosing and would pay the minor for the date. The victims testified that on most occasions, they were required to give Williams the money they collected for their prostitution services. Several of the victims testified that Williams provided them with illegal narcotics, including marijuana and crack cocaine, and that he engaged in or attempted to engage in sexual activity with them.

Columbus, OH
Carl W. Shye, Jr., 57, of New Albany, Ohio, was sentenced in U.S. District Court today to 24 months in prison and ordered to repay $472,579.90 in federal funds that he embezzled between 2005 and 2011 while serving as treasurer for four community schools in Ohio.

Shye pleaded guilty on June 21, 2012, to one count of embezzlement. Shye admitted that, between October 2005 and September 2011, Shye used his position as treasurer of multiple Ohio community schools to embezzle from the schools that employed him.

The schools involved include the former George Washington Carver Preparatory Academy which was located in Columbus, Ohio; the former Legacy Academy for Leaders & Arts which was in Youngstown, Ohio; and the former NuBethel Center of Excellence and New City Community School, both in Dayton.

Crimes against Children 10-29-12

Norwich, CT
A 33-year-old city man suspected of possessing and sharing images and videos of child pornography was arrested at his home on Friday, the state police said.

Jason Fraser, of P.O. Box 73 Lebanon, Norwich, was charged with one count of first-degree possession of child pornography with bail set at $50,000.

A computer crimes unit of the state police allegedly discovered that child pornography files were shared from an Internet account at based out of Fraser's home. Police served a warrant Friday, seizing evidence that contained such files, according to a police report.

Huntington, WV
U.S. Attorney Booth Goodwin announced today that a Michigan man pleaded guilty in federal court to traveling in interstate commerce with intent to engage in illicit sexual conduct with a minor.

Ashlee C. Liebert, 33, of Whitmore Lake, Michigan, admitted that for approximately five months, beginning in November 2011 through March 2012, he established a relationship with a 12-year-old minor residing in Putnam County, West Virginia. Liebert admitted that he communicated with the minor by e-mail and cellphone where they had conversations that were sexual in nature. Liebert further admitted that he exchanged sexually explicit images with the minor.

Memphis, TN
Virtually everyone has a cellular telephone with a camera and most people use them in a responsible manner. But this week, three individuals were sentenced by U.S. District Judge Samuel H. Mays for using their phones to produce or receive child pornography.

John Vincent LaBuda, 31, of Shelby County, pleaded guilty to one count of production of child pornography and was sentenced to 360 months in federal prison. He also pleaded guilty to one count of possession of child pornography and was sentenced to 120 months that will run concurrently.
In an unrelated case, husband and wife Daryl Wayne Maness, 38, and Shannon Ann Maness, 37, both of Chester County, Tennessee, pleaded guilty to one count each of receiving child pornography, and were each sentenced to 120 months in prison.

All three will also be be subject to 15 years of supervised release, during which time they must register as sex offenders, participate in sex offender treatment, have no contact with minors, and refrain from accessing or possessing pornography of any kind. The also may not live near places where minors are likely to be, such as parks or swimming pools.

Charleston, WV
U.S. Attorney Booth Goodwin today announced that a Boone County man was sentenced to eight years and one month in federal prison, followed by 15 years of supervised release, for receiving child pornography. Daniel C. Runion, 27, of Seth, Boone County, West Virginia, previously pleaded guilty in June. Runion admitted that on July 29, 2011, he used his computer and a file sharing program to knowingly receive via the Internet child pornography; that is, images and videos of minors engaged in sexually explicit conduct, including actual or simulated sexual intercourse and the lascivious exhibition of the genitals and pubic area of the minors. Runion admitted that he received and transported the images and videos of the minors while at a residence in Seth. Runion further admitted that he knew the images and videos constituted child pornography.

The investigation revealed that Runion knowingly possessed more than 600 images and videos on his computer depicting minors engaged in sexually explicit conduct. Some of the images have been identified as known children.

Baltimore, MD
Brian Matthew Williams, age 28, of West Chester, Pennsylvania, pleaded guilty today to receipt of child pornography.

“This defendant egregiously violated the privacy of young boys by secretly recording them in public restrooms, a crime that gives every parent nightmares,” said U.S. Attorney Rod J. Rosenstein. “I am grateful to the vigilant citizen who noticed the unusual behavior and immediately called 911 and to the police and prosecutors who conducted an urgent investigation.”

According to his plea agreement, on May 6, 2012, Williams spent nearly five hours at the Maryland House and Chesapeake House rest stops on I-95, going in and out of the men’s restrooms filming several minor males, most of whom were pre-pubescent, as they used the urinals. Williams positioned himself at an adjacent urinal and used his cellular telephone to create 21 videos focused on the genitals of minor males. Two of the videos depict two minor males urinating and captures images of one of the pre-pubescent minor male’s exposed penis. After capturing the images of the minor males using the urinals, Williams would exit the restroom and wait for the minor males to walk out, then capture full length images of the minor males, including their faces. After the parents of one of the victims reported Williams’ suspicious behavior to Maryland State Police, he was arrested, charged in Cecil County, and released on bond the same day.

Louisville, KY
According to the sentencing memorandum, John Dennis Clark, III used a Yahoo! Flicker account to upload 13,800 images of child pornography from January 2, 2007 to June 17, 2007. Flickr users who discovered the images complained to Yahoo! about the presence of child pornography associated with the “audriusmackevicius” account. Yahoo! submitted 13,800 images as a cybertip report to The National Center for Missing & Exploited Children (NCMEC) on August 15, 2008. NCMEC referred the investigation to the FBI. The FBI traced the Internet protocol to an Insight account on Iola Road in Louisville, Kentucky. On January 7, 2009, the FBI executed a search warrant and seized Clark’s laptop computer and several items related to international travel. The Regional Computer Forensic Laboratory (RCFL) conducted a forensic examination of Clark’s laptop and discovered thousands of images of child pornography consisting of mostly prepubescent boys engaged in sexual activity. Seven days later, Clark fled the United States from Chicago to Warsaw, Poland. On or about February 27, 2009, during a check of international border crossing records, law enforcement discovered that Clark had fled the United States for Eastern Europe in a failed attempt to avoid prosecution.

Denver, CO
Peter Robert James, age 43, of Colorado Springs, Colorado, was sentenced by Chief U.S. District Court Judge Wiley Y. Daniel to serve 180 months (15 years) in federal prison for distribution of child pornography, the United States Department of Justice, the Internet Crimes Against Children Task Force (ICAC), the Colorado Springs Police Department, and U.S. Immigration and Customs Enforcement (ICE) Homeland Security Investigations (HSI) announced. Following his prison sentence, James was ordered to spend 10 years on supervised release. Chief Judge Daniel also ordered James to pay restitution totaling $5,000 to the two victims of his crime, with each receiving $2,500. The defendant appeared at the hearing free on bond, and was remanded into custody at the conclusion of the sentencing hearing.

According to the stipulated facts contained in the plea agreement, on August 10, 2010, a police officer in the Child Exploitation Section of the Sex Crimes Unit of the Toronto Police Service signed on to a file-sharing program account of an individual who had been arrested by the London Police Service for possession of child pornography. The Toronto police officer observed that a person using a specific user name was online. The officer browsed the 14 top-level directories that the target was sharing. While browsing the directories and subdirectories, the officer observed many images of child pornography. The officer captured thumbnails of more than 3,000 of these browsed images. The collection of files were both large and well-organized. The officer determined that the username in question’s IP address was registered to Comcast Cable with the user located in Colorado Springs. The officer ultimately downloaded 82 files from the target, which included 71 images of child pornography and five videos of child pornography. The Toronto Police Department referred the findings of their investigation to HSI, who in turn referred the case to the Colorado Springs Police Department.

Baltimore, MD
U.S. District Judge Marvin J. Garbis sentenced Joel Stevens, age 52, of Baltimore, Maryland, today to four years in prison followed by a lifetime of supervised release for possessing child pornography. Judge Garbis ordered that upon his release from prison, Stevens must register as a sex offender in the place where he resides, where he is an employee, and where he is a student, under the Sex Offender Registration and Notification Act (SORNA).

The sentence was announced by United States Attorney for the District of Maryland Rod J. Rosenstein and Special Agent in Charge Stephen E. Vogt of the Federal Bureau of Investigation.

According to the plea agreement, on October 8, 2010 Stevens offered to share online digital images of “nice young girls or under 12” to another individual. Stevens discussed sharing files and provided the passwords so that the individual could access Stevens’ child pornography images and videos. Stevens made 77 digital files available to the other user, which contained visual depictions of minors under the age of 12 engaging in sexually explicit conduct.

Baltimore, MD
U.S. District Judge Catherine C. Blake sentenced David Mitchell Rowe, age 65, of Linthicum, Maryland, today to 12 years in prison followed by a lifetime of supervised release for using a cell phone to coerce a minor to engage in sexual activity. Judge Legg ordered that upon his release from prison, Rowe must register as a sex offender in the place where he resides, where he is an employee, and where he is a student, under the Sex Offender Registration and Notification Act (SORNA).

The sentence was announced by United States Attorney for the District of Maryland Rod J. Rosenstein; Special Agent in Charge Stephen E. Vogt of the Federal Bureau of Investigation; Anne Arundel County Police Chief Larry W. Tolliver; Chief James W. Johnson of the Baltimore County Police Department; and Baltimore County State’s Attorney Scott Shellenberger.

According to his plea agreement, in June of 2011, Rowe was a member of the swimming pool association at a hotel in Linthicum, Maryland, where he befriended a 9-year-old girl. Over the course of a few days, Rowe played games in the pool with the girl, wrestled with her, touched her vagina over her bathing suit, and exposed his penis while she was underwater.

New York, NY
Juan Carlos Escobar Gonzalez was sentenced today to 188 months of imprisonment for raping an undocumented 17-year-old El Salvadoran girl in the back of a van at a rest stop in New Jersey while transporting her from Texas to her family in New York. The sentence will run consecutively to the 57-month sentence the defendant received in an alien smuggling case in the Eastern District of Texas in May 2010. The sentencing proceeding was held today before United States District Judge Sterling Johnson, Jr., at the U.S. Courthouse in Brooklyn, New York. The defendant was convicted after trial in November 2011 of interstate transportation of a minor with intent to engage in illegal sexual activity, interstate travel with intent to engage in illicit sexual conduct with a minor, and alien smuggling.


Dayton, OH
An Ohio man accused of raping a boy who authorities say was brought to his home by the boy's adoptive father is now facing child pornography charges.

The Montgomery County prosecutor said Monday that 32-year-old Patrick Rieder (REE'-dur) has been indicted on charges that include 49 counts of pandering sexually oriented material involving a minor.

Prosecutor Mat Heck Jr. says the charges come after a search warrant was executed at Rieder's home, and child pornography was discovered on his computers and other electronic equipment.

Collinsville, IL
Federal investigators say a Collinsville, Ill. man has been charged for producing child pornography to share on the internet.

The federal indictment shows the alleged abuse and production of child pornography was going on for more than two years, and a child advocate said that gives her reason to believe other children could have been in the same danger.

Martin Evanick, 31, who goes by Vlad, portrays himself as a maniacal clown on his Facebook page, which says he’s a drummer in the band “The Core of Your Nightmares.”

Federal investigators said, in April, Evanick took inappropriate pictures of himself engaged in a sex act with a child.  According to a press release sent from the U.S. Attorney’s office, the alleged violations happened in Madison County in June of 2010 and then again a year later in June of 2011.

A 27-year old Coral Springs man has been arrested and charged with possessing child pornography.
Justin Aaron was charged with dozens of counts.

After an investigation by the Broward Sheriff’s Office, deputies went to his home and found a laptop and external hard drive with dozens of child porn videos.

According to the probable cause affidavit, Aaron admitted to possessing, downloading and saving numerous child porn videos on his computer. He also stated that he’s been downloading child porn for approximately two to three years, according to the affidavit.

Crimes against Children 10-19-12 Part II

Albuquerque, NM
This morning in Albuquerque federal court, Kenneth Mike Etsitty, 58, an enrolled member of the Navajo Nation who resides in Tse-Yah-Toh, New Mexico, pled guilty to an information charging him with three counts of aggravated sexual abuse of a child under the age of 12.

U.S. Attorney Kenneth J. Gonzales said that, under the terms of the plea agreement, Etsitty will be sentenced to 18 years of imprisonment to be followed a supervised release term to be determined by the court. Etsitty also will be required to register as a sex offender. Etsitty remains in federal custody pending his sentencing hearing, which has yet to be scheduled.

Etsitty was charged with aggravated sexual abuse in a criminal complaint filed on May 14, 2012. He was arrested the following day and has been in federal custody since that time.

According to the criminal complaint, the FBI initiated a criminal investigation into Etsitty in February 21, 2012, after a 9-year-old Navajo child disclosed that Etsitty had sexually assaulted her more than 10 times by penetrating her vagina with his finger. Thereafter, during a voluntary interview, Etsitty admitted sexually assaulting the child victim on approximately 10 occasions from the time she was 4 years old and until November 2011 by digitally penetrating her vagina.

Albuquerque, NM
This morning in federal court, Justin Gray, 33, of Ruidoso, New Mexico, was sentenced to a 22-year term of imprisonment to be followed by a lifetime of supervised release for his receipt of child pornography conviction, announced U.S. Attorney Kenneth J. Gonzales. Gray also will be required to register as a sex offender.

Gray was indicted on July 13, 2011, in a six-count indictment charging him with three counts of distribution and attempted distribution of visual depictions of minors engaged in sexually explicit conduct; one count of receipt of visual depiction of a minor engaged in sexually explicit conduct; and two counts of possession of matter containing visual depictions of minors engaged in sexually explicit conduct. According to the indictment, Gray distributed child pornography in October 2010, November 2010, and February 2011; received child pornography in September 2010; and possessed child pornography in March 2011. Gray was arrested on September 12, 2011, and has been in federal custody since that time.

Minneapolis, MN
United States Attorney Brendan V. Johnson announced that Tyrel DeMarrias, a/k/a Tyrell DeMarrias, age 24, of Wakpala, appeared before United States District Judge Charles B. Kornmann on October 16, 2012, and pled guilty to an indictment that charged him with sexual assault of a minor. The maximum penalty upon conviction is 15 years in custody, a $250,000 fine, or both.

The conviction arose from the sexual assault of a minor victim in Wakpala, South Dakota, in September 2011. The investigation was conducted by the Federal Bureau of Investigation and the Bureau of Indian Affairs-Standing Rock Agency. The case is being prosecuted by Assistant United States Attorney Mikal Hanson.

Spokane, WA
Today, Michael C. Ormsby, United States Attorney for the Eastern District of Washington, announced that LaShuan Roman Nose, age 33, of Elk City, Oklahoma, was sentenced after having been convicted by a jury of assault resulting in substantial bodily injury in connection with the abuse of a toddler. Senior District Court Judge Edward F. Shea imposed the statutory maximum sentence of five years’ imprisonment, to be followed by three years of court supervision upon release from prison.

Tampa, FL
A Tampa man faces 50 counts of child pornography possession after he was spotted looking at pictures on the sidewalk of a strip mall, police said.

Benjamin Ashauer, 29, was at the Terrace Collections on East Busch Boulevard in Tampa when a shopper saw what was on his laptop.

Police were called, and they inspected his computer.

Police said they found several pictures of child porn.

Noblesville, IN
Samuel Barnette, 42, Noblesville, faces as many as 20 years in federal prison if he is convicted of charges of distributing child pornography.

Barnette, a former custodian at Promise Road Elementary School, was charged Thursday and if convicted, also could be levied a $250,000 fine and placed on supervised release for life after he completes any prison term.

A lost cell phone on a public transit bus landed a Deerfield Beach man behind bars charged with possession of child pornography.

Last August, someone turned in a black and blue Samsung cell phone To the Broward Sheriff’s Office which they said they found on a county bus seat in Pompano Beach. The person said when they looked through the phone’s contents they found a number of images of child pornography.

The phone was turned over to the Detective Jennifer Montgomery, a member of the Internet Crimes Against Child Task Force. A forensic check of the phone’s contents found 463 saved images in the Media/Images Download Folder. A majority of the images, according to the forensic report, depicted nude girls between the ages of three and 12 displaying their genitals or performing sex acts.

Reno, NV
David GonzalezA 26-year-old who had more than 2,000 child pornography videos and images and who said his favorite show was “SpongeBob SquarePants” was sentenced Thursday to more than seven years in federal prison.

In a teary plea, David Gonzalez of Reno asked the judge to give him the minimum sentence of five years in prison because he was frequently sexually abused as a child by a relative and a family friend, and was beaten by his mother on a constant basis.


Gonzalez pleaded guilty to receipt of child pornography after he was caught sharing the illicit images last year by detectives in the Internet Crimes Against Children Task Force.
